The terms on which Melanoir Co., Ltd. sells MELANOIR BLACK to trained practitioners. It is written plainly because you should be able to read it without a lawyer. Read it with the shipping policy and the returns, exchanges and refunds page — the three are one set and carry one version number, and placing an order means agreeing to all three.
Professional use only. MELANOIR BLACK is supplied to trained practitioners. It is not sold to consumers and is not intended for self-application.
Every order carries one required confirmation, and it is this one, word for word:
“I confirm that I am a trained tattoo or permanent makeup professional and that this product will be used only for professional intradermal application. This product is not for retail sale or consumer use.”
We record that you gave it, the wording you gave it against, and the time. That record is version pro-ack-v1. If the wording changes, the version moves with it and the old wording is kept.
We do not verify licences and do not hold ourselves out as able to. The confirmation is your statement, not our finding. Placing an order without being able to make it truthfully is a breach of these terms.
Handling, first aid and information for medical professionals are in the product information guide supplied with the product. Regulatory documentation, including the Safety Data Sheet, is available on request from the address above.
An order is a request until we confirm it. We confirm the quantity, the shipping figure and the total on your order, and only then is payment taken. Where the shipping figure for your order has not been quoted yet, the total is not yet fixed and no payment can be taken against it.
While payment is not open, the order form registers a pre-order and takes no money. A pre-order is not a contract of sale and creates no obligation on you to buy; we come back to you when the product can actually be sent.
MELANOIR BLACK is not registered or officially distributed in your country. Ordering it means importing it on your own initiative, before official distribution exists.
Your parcel may be delayed, inspected, returned or seized by customs, and in some cases it may never arrive. Melanoir cannot influence or predict the decisions of customs authorities. Confirming whether this product may be imported and used where you are, and any professional or licensing requirements that apply to your work, is your responsibility. Melanoir does not give legal or regulatory advice.
We declare shipments as what they are, at their actual value, and we will not mis-declare a parcel to help it through customs. If your parcel is seized or returned and cannot be delivered, we will refund the product price once the outcome is confirmed. Shipping fees are non-refundable, and we do not re-ship seized orders.
These form part of the Terms of Sale you accept when you order, and we record which version of the wording you accepted, with the time you accepted it. The wording on this page is that wording.
Melanoir Co., Ltd. provides a voluntary limited warranty against defects in materials or manufacture, identified within two years of the date of manufacture in unopened condition. The remedies under it are limited to replacement or refund. It is set out in full, with what it does not cover, on the returns page.
This warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction.
In this section, “Melanoir” means Melanoir Co., Ltd., the seller of this product.
Melanoir is not liable for damage that does not arise from a breach of the terms of this warranty, or for loss of data or profit arising from the user’s own conduct. Melanoir accepts no liability for outcomes arising from the practitioner’s technique, from inadequate aftercare, or from an individual’s constitutional characteristics, including allergic reactions. Melanoir does not warrant or represent any particular outcome of use, including degree of pigmentation or symmetry.
Melanoir accepts no liability whatsoever for physical injury, infection, adverse effects or legal disputes arising from the use or misuse of any pharmaceutical product, including anaesthetics, which Melanoir neither supplies nor advises on.
The limitations set out in this document do not apply to liability for death or personal injury, or for fraud or gross negligence, where applicable product liability law makes such liability mandatory. Otherwise, and save where a manufacturing defect in the product itself is demonstrated, Melanoir is not liable for adverse effects arising from any failure to observe the usage instructions, warnings and aseptic technique set out in the product information guide.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Anyone can file — the practitioner, the client, or someone reporting for them, with or without giving a name. What we do with the report, where it is stored and how long we keep it are set out in the privacy notice.
What we collect when you order, why we hold it, how long we keep it, and who else sees it are set out in the privacy notice. One email to official@melanoir.co.kr covers a copy, a correction, or deletion.
Melanoir Co., Ltd. is established in the Republic of Korea. Nothing in these terms limits any right you have under the consumer protection or product liability law that applies to you where you are.
If something goes wrong, write to official@melanoir.co.kr first. We would rather settle it directly than have either of us discover which court hears it.
